1. About these terms
These terms and conditions apply to:
- your use of the cdw.glitch.mt website, referred to as the “Website”;
- the purchase, possession, transfer and use of tickets for Glitch events;
- entry to and attendance at any event promoted or organised under the Glitch name, referred to as an “Event”.
The Website and Events are operated by Boing Ltd, a company registered in Malta under company registration number C 73818, with its registered office at 116, Constitution Street, Mosta, MST 9055, Malta.
Boing Ltd operates and promotes its events under the Glitch and Glitch Festival names. In these terms, Boing Ltd is referred to as “Glitch”, the “Organiser”, “we”, “us” or “our”.
A person who purchases a ticket is referred to as the “Purchaser”. A person who holds or uses a ticket, or attends an Event, is referred to as an “Attendee”.
By using the Website, purchasing or holding a ticket, or attending an Event, you agree to these terms.
Nothing in these terms limits any consumer or other legal rights that cannot lawfully be excluded.
2. Use of the Website
The Website is provided for general information, event promotion, ticket sales, merchandise sales and related services.
You must not:
- use the Website for any unlawful, fraudulent or unauthorised purpose;
- attempt to gain unauthorised access to the Website, its servers or connected systems;
- introduce viruses, malicious code or other harmful material;
- interfere with the proper operation or security of the Website;
- use automated systems, scripts or bots to purchase tickets or bypass ticket limits;
- copy or commercially exploit Website content without our permission;
- provide false or misleading information during a purchase or registration process.
We may suspend, restrict or withdraw access to the Website where reasonably necessary for maintenance, security, operational or legal reasons.
We do not guarantee that the Website will always be available, uninterrupted, secure or free from errors.
3. Ticket contract
Tickets may only be purchased through:
- the official Glitch Website;
- Glitch’s authorised ticketing provider;
- TicketSwap, where tickets are offered for authorised resale;
- another seller expressly authorised in writing by Glitch.
A contract for a ticket is formed when the Purchaser receives an order confirmation from the authorised ticketing provider.
Submitting payment details or completing a payment attempt does not guarantee a ticket unless an order confirmation has been issued.
Ticket availability is subject to Event capacity.
We may limit the number of tickets that may be purchased by one person, household, payment method, email address, account or device.
The authorised ticketing provider may apply its own terms to the processing of orders, payments, ticket delivery, ticket personalisation and customer accounts.
4. Ticket information
A ticket provides admission to the Event and ticket category stated on the ticket, subject to these terms and any Event-specific conditions communicated before purchase.
A ticket is purchased for the Event as a whole and not for the appearance of any particular artist, performer, stage, host, attraction or activity.
The Purchaser is responsible for checking that the correct Event, date, ticket category and quantity have been selected before completing the purchase.
The Purchaser must provide complete and accurate information when placing an order.
5. Ticket delivery and delayed fulfilment
Tickets may be issued immediately or released closer to the Event for operational, security and anti-fraud reasons.
Glitch may use delayed fulfilment or sealed tickets. Where delayed fulfilment applies, the Purchaser may receive an order confirmation before receiving the downloadable ticket or barcode.
The Purchaser is responsible for:
- providing a valid email address;
- checking spam and junk-mail folders;
- completing any required ticket personalisation;
- downloading or accessing the ticket before travelling to the Event;
- keeping the ticket and barcode secure.
The release date for delayed tickets will be communicated through the ticketing provider, the Website or other official Glitch channels.
6. Ticket validity and scanning
Each ticket and barcode is unique.
Entry will normally be granted only to the first person who presents a valid ticket for scanning.
Glitch is not required to determine which person is the legitimate purchaser where multiple people present copies of the same ticket.
Screenshots, copied tickets, duplicated barcodes, altered tickets and tickets obtained through unauthorised sellers may be refused.
A ticket that has already been scanned, cancelled, refunded, transferred or reported as fraudulent is invalid.
7. Ticket resale and transfer
TicketSwap is the only authorised resale platform for Glitch tickets.
Tickets must not be resold, advertised or transferred through:
- social-media accounts or groups;
- online marketplaces;
- unofficial ticketing websites;
- individuals acting as unauthorised ticket brokers;
- any other platform not expressly authorised by Glitch.
Glitch cannot verify or guarantee tickets purchased outside the official ticket shop or TicketSwap.
Tickets purchased from an unauthorised source may be fraudulent, duplicated, cancelled or otherwise invalid. Entry may be refused without a refund.
Glitch may cancel a ticket where it:
- has been advertised or sold through an unauthorised platform;
- has been obtained fraudulently;
- has been purchased using an automated system;
- breaches an advertised ticket limit;
- is resold for commercial gain;
- is used in an unauthorised promotion, competition or package;
- has been altered, duplicated or transferred contrary to these terms.
Any permitted ticket transfer, resale or name change remains subject to the conditions and fees of the relevant authorised ticketing or resale provider.
8. Refunds and changes of mind
Unless otherwise stated during the purchase process, tickets are non-refundable and non-exchangeable where the Purchaser:
- changes their mind;
- is no longer able to attend;
- purchases the wrong Event or ticket category;
- makes a duplicate purchase;
- encounters travel, accommodation or visa difficulties;
- misses the Event or arrives after the published admission time;
- is refused entry or removed in accordance with these terms.
Tickets for Events taking place on a specific date or during a specific period may not benefit from the standard statutory cooling-off period that applies to certain other online purchases.
This section does not affect any refund or remedy that must be provided under applicable law.
9. Programme and artist changes
Glitch will make reasonable efforts to ensure that advertised artists and performers appear.
However, the programme, lineup, performers, stages, stage hosts, performance times, running order, Event layout and other Event details may change.
Glitch may add, replace, reschedule or remove an artist, performer, stage, attraction or activity without prior notice.
A change to the lineup, running order, performance time, stage allocation or Event layout will not normally entitle the Purchaser to a refund, provided that the Event itself takes place.
Any rights arising from a material change under applicable law remain unaffected.
10. Event cancellation, postponement and rescheduling
Glitch may cancel, postpone, relocate, reschedule, shorten or materially alter an Event where reasonably necessary.
Where an Event is postponed or rescheduled, tickets will normally remain valid for the replacement date.
Glitch will communicate the available ticket options, refund procedure and applicable deadlines through one or more of the following:
- the Website;
- email;
- official social-media channels;
- the authorised ticketing provider.
Where an Event is cancelled and is not rescheduled, ticket refunds will be handled in accordance with applicable law and the instructions issued by Glitch or the authorised ticketing provider.
Unless required otherwise by law, Glitch will not be responsible for travel, accommodation, visas, transport, meals, loss of earnings or other indirect costs connected with an Event cancellation, postponement or rescheduling.
Attendees are advised to make flexible or refundable travel and accommodation arrangements.
11. Circumstances beyond our reasonable control
Circumstances beyond Glitch’s reasonable control may include:
- severe or dangerous weather;
- natural disasters;
- fire, flooding or structural damage;
- epidemics, pandemics or public-health emergencies;
- war, terrorism or credible security threats;
- civil disorder or public disturbance;
- strikes or serious transport disruption;
- electricity, communications or technology failures;
- government restrictions or emergency measures;
- refusal, suspension or withdrawal of a required permit;
- orders or directions issued by public authorities;
- illness or unavailability affecting essential Event personnel;
- any other circumstance that could not reasonably have been prevented by Glitch.
Glitch may take reasonable measures in response, including changing the Event date, location, capacity, opening times, programme, layout or operating procedures.
The fact that an Event is affected by circumstances beyond our control does not automatically determine whether a refund is due. Refunds and other remedies will be assessed according to the circumstances, these terms and applicable law.
12. Opening Party conditions
The location of an Opening Party may be subject to permits, approvals or operating conditions imposed by public authorities.
Where the advertised venue cannot be used, Glitch may relocate the Opening Party to a reasonable alternative venue.
A change of venue will not normally entitle the Purchaser to a refund where the Opening Party proceeds on the advertised date with a substantially similar programme.
Any mandatory consumer rights remain unaffected.
13. Boat Party conditions
Boat Party schedules may be delayed, shortened, relocated or changed because of weather, sea conditions, port restrictions, operational requirements or instructions from the vessel’s captain or competent authorities.
The vessel’s captain has final authority concerning the safe operation of the vessel.
Where conditions make it unsafe for a Boat Party to sail, Glitch may:
- change the departure time;
- use an alternative vessel;
- alter the route or duration;
- move the Event to a land-based alternative venue;
- reschedule the Boat Party;
- cancel the Boat Party.
Where the Boat Party is moved to a reasonable alternative venue and proceeds with a substantially similar programme, no refund will normally be due.
Where the Boat Party is cancelled without a replacement Event, Glitch will communicate the applicable refund procedure.
14. Age restriction
Glitch Events are restricted to persons aged 17 or over, unless a different age restriction is expressly stated for a particular Event.
The minimum age applies on the date of the Event.
Glitch may require an Attendee to produce an original and valid government-issued photographic identification document.
Acceptable identification may include:
- a passport;
- a national identity card;
- a driving licence.
Photographs, screenshots, scans and photocopies may not be accepted.
A ticket purchased for or used by a person below the minimum age is invalid.
Subject to applicable law, no refund will be issued where entry is refused because an Attendee does not meet the age requirement or cannot provide acceptable identification.
15. Admission
Admission is subject to:
- presentation of a valid ticket;
- compliance with the age restriction;
- completion of security checks;
- compliance with these terms;
- compliance with reasonable instructions given by Event staff, security personnel, the venue or public authorities.
Possession of a ticket does not provide an unconditional right of entry.
Glitch, the venue and authorised security personnel may refuse admission or remove an Attendee where there are reasonable grounds relating to safety, security, public order, fraud, capacity or compliance with these terms.
No refund will normally be issued where entry is refused or an Attendee is removed in accordance with these terms.
16. Security searches
Attendees and their belongings may be searched before entry or while inside the Event.
Security measures may include:
- bag searches;
- body searches carried out by authorised personnel;
- ticket and identification verification;
- wristband checks;
- checks using appropriate security equipment.
Entry may be refused where an Attendee refuses to cooperate with a lawful and reasonable security search.
Prohibited items may be confiscated.
Illegal items may be handed to the police or another competent authority.
17. Conduct
Attendees must behave responsibly and must not endanger, threaten, harass or unreasonably disturb another person.
Glitch may refuse admission or remove an Attendee who:
- is violent, abusive, threatening or disorderly;
- appears excessively intoxicated;
- possesses, supplies or uses illegal substances;
- damages property;
- enters a restricted area;
- climbs barriers, stages, structures or equipment;
- interferes with Event operations or security;
- engages in harassment, discrimination or unwanted sexual conduct;
- sells tickets, goods or services without permission;
- breaches these terms;
- refuses to follow a reasonable instruction from Event staff.
Glitch operates a zero-tolerance policy towards illegal substances, violence, harassment and threatening behaviour.
Serious incidents may be reported to the police.
18. Prohibited items
Unless expressly permitted by Glitch, Attendees must not bring the following into an Event:
- weapons or objects that may reasonably be used as weapons;
- fireworks, flares, smoke devices or pyrotechnics;
- illegal substances;
- glass containers;
- plastic bottles, PET bottles, cans or outside drinks;
- outside food, unless required for medical or accessibility reasons;
- large containers, cooler bags or hard packaging;
- compressed-gas canisters;
- drones;
- professional photography or recording equipment;
- laser devices;
- hazardous, flammable or toxic substances;
- large flags, poles or objects that may create an obstruction or safety risk;
- any item prohibited through Event-specific information.
Glitch may update the prohibited-items list for safety, security or operational reasons.
Medication and accessibility-related items will be handled reasonably. Supporting documentation may be requested where appropriate.
19. Wristbands
Where wristbands are used, the wristband must remain securely attached for the period stated by Glitch.
Wristbands may be checked at entrances and anywhere within the Event grounds.
Attendees must not:
- remove their wristband;
- cut or stretch their wristband;
- transfer or exchange their wristband;
- sell their wristband;
- tamper with or alter their wristband.
A wristband that has been removed, transferred, cut, stretched, damaged or tampered with may become invalid.
Glitch may refuse entry or remove an Attendee where there are reasonable grounds to believe that a wristband is invalid or has been tampered with.
A replacement wristband is not guaranteed and may be subject to verification and an administration charge.
Re-entry is only permitted where expressly confirmed by Glitch.
20. Health and safety
Attendance at a live music Event involves normal risks associated with crowds, loud music, lighting effects, temporary structures, uneven ground and weather conditions.
Attendees must follow all safety signs, announcements and instructions from Event staff.
Anyone who feels unwell or requires assistance should immediately contact security, medical personnel or Event staff.
Glitch may stop a performance, evacuate an area, restrict movement or take another reasonable measure where required for safety.
21. Sound levels and hearing protection
Glitch Events may involve high sound levels.
Attendees are strongly advised to:
- use suitable hearing protection;
- take regular breaks from high-volume areas;
- maintain a safe distance from loudspeakers;
- seek assistance if they experience discomfort.
Free disposable earplugs may be available from the designated information or merchandise point, subject to availability.
22. Lighting and special effects
Events may use strobe lighting, lasers, smoke, haze, pyrotechnics and other visual or atmospheric effects.
Attendees who may be affected by these effects should seek appropriate medical advice before attending.
Information or assistance may be requested from Event staff.
23. Photography, filming and recording
Photography, video recording and audio recording may take place throughout the Event for security, documentary, archival, editorial and promotional purposes.
By entering the Event, Attendees acknowledge that they may appear incidentally in crowd photographs or recordings.
Glitch may use Event photographs and recordings through its websites, social-media channels, advertising, press materials, broadcasts and future Event promotions, subject to applicable law.
Professional or commercial photography, filming, live streaming or audio recording is not permitted without prior written approval from Glitch.
Personal photography using a mobile phone or small personal camera may be permitted, subject to Event-specific restrictions and respect for the privacy and rights of others.
24. Cashless payments, RFID credit and tokens
An Event may operate using RFID wristbands, cashless credit, cards, tokens or another Event payment system.
Event credit or tokens may only be valid for the Event, Event period or Event location for which they were issued.
Credit is not refundable and will not be carried forward to another Event unless Glitch expressly states otherwise.
25. Refund protection
Optional refund protection may be offered during checkout by Booking Protect or another independent refund-protection provider identified during the purchase process.
Refund protection is a separate agreement between the Purchaser and the provider.
It is subject to the provider’s own:
- eligibility requirements;
- covered circumstances;
- exclusions;
- claim deadlines;
- evidence requirements;
- terms and conditions.
Glitch and its ticketing provider do not determine whether a refund-protection claim is accepted.
Refund protection can normally only be purchased during the original ticket order.
Questions and claims relating to refund protection must be directed to the provider.
The purchase of refund protection does not limit any statutory rights the Purchaser may have against Glitch.
26. Personal belongings and lost property
Attendees remain responsible for their personal belongings.
Glitch is not responsible for loss, theft or damage to personal property except where liability cannot lawfully be excluded.
Any lost property handed to Glitch will be kept for a limited period.
Unclaimed items may be disposed of, donated or handed to the relevant authorities.
27. Parking and transport
Any parking, shuttle or transport service connected with an Event may be operated by a third party and may be subject to separate terms.
Vehicles are parked at the owner’s risk.
Attendees must follow all parking, traffic and transport instructions.
Glitch is not responsible for delays, cancellations or disruption affecting public transport, private transport, taxis, flights, ferries or other third-party services.
28. Liability
Glitch will exercise reasonable care in organising and operating its Events.
To the fullest extent permitted by law, Glitch will not be liable for:
- loss caused by an Attendee’s own act or omission;
- loss caused by a breach of these terms;
- loss caused by a third-party supplier outside Glitch’s reasonable control;
- indirect or consequential loss;
- loss of travel, accommodation, income, business or opportunity;
- loss or damage that was not reasonably foreseeable when the ticket contract was formed.
Nothing in these terms excludes or limits liability where it would be unlawful to do so.
This includes liability for fraud, wilful misconduct, or death or personal injury caused by negligence where such liability cannot legally be excluded.
29. Third-party services and links
The Website may contain links to ticketing providers, TicketSwap, payment processors, refund-protection providers, accommodation providers, transport services, artists, sponsors, social networks and other third parties.
Glitch does not control third-party websites or services and is not responsible for their availability, content, security, privacy practices or separate contractual terms.
Users should read the applicable terms and privacy notices before using a third-party service.
30. Merchandise
Merchandise purchases may be subject to separate checkout, delivery, return and store terms.
Nothing in these terms removes any statutory rights that apply to the purchase of merchandise, including any applicable right of withdrawal or rights relating to faulty goods.
Event-ticket refund conditions do not automatically apply to merchandise purchases.
31. Intellectual property and trademark
The Website and its content, including the Glitch and Glitch Festival names, logos, artwork, photographs, video, audio, graphics, text and designs, are owned by or licensed to Boing Ltd.
Glitch Festival is a registered trademark of Boing Ltd.
Website content may not be copied, modified, distributed, sold, published or commercially exploited without prior written permission.
Nothing in these terms transfers any intellectual-property rights to a Website user, Purchaser or Attendee.
32. Privacy and personal data
Personal data is processed in accordance with the separate Glitch Privacy Policy.
The use of cookies and similar technologies is explained through the Glitch Cookie Policy and cookie-consent settings.
Acceptance of these terms does not automatically constitute consent to receive marketing communications.
33. Marketing communications
Where required, Glitch will request consent for marketing communications separately from acceptance of these terms.
A person may unsubscribe from marketing emails at any time by using the unsubscribe link contained in the communication.
Transactional and operational communications relating to a ticket, order or Event may still be sent where necessary, even where a person has opted out of marketing.
34. Changes to these terms
Glitch may update these terms for legal, regulatory, safety, security or operational reasons.
The terms in effect when a ticket is purchased will normally apply to that purchase.
A later change will not retrospectively remove a Purchaser’s existing statutory or contractual rights.
Where an important change affects an upcoming Event, Glitch will take reasonable steps to communicate it through the Website, email, official social-media channels or the authorised ticketing provider.
35. Severability
If any provision of these terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect.
Any invalid provision will be interpreted or adjusted only to the minimum extent necessary to make it valid and enforceable, where legally possible.
36. No waiver
A failure or delay by Glitch in enforcing a right under these terms does not amount to a waiver of that right.
37. Governing law and jurisdiction
These terms are governed by the laws of Malta.
The courts of Malta will have jurisdiction, without limiting any mandatory right that a consumer may have to bring proceedings in another competent jurisdiction.
